Needless to Say, YSL Is Having None of Louboutin’s Appeal

Guess what legal case that you’re sick of will drag on into 2012? Louboutin versus YSL, of course. YSL’s lawyers filed their appellate brief in New York today in response to Christian Louboutin’s appeal of the court ruling in October. Last April, Louboutin filed a preliminary injunction against YSL for selling red-soled shoes, which Louboutin trademarked in 2008. The case went to court, where Judge Victor Marrero not only denied the injunction request, but suggested that Louboutin’s red-sole trademark was invalid, reasoning that no designer should have a “monopoly” on the color red. Louboutin promptly appealed the decision, and YSL has held fast to their argument: According to today’s filing, YSL’s lawyers have restated their convictions that no consumer would confuse a YSL shoe for a Christian Louboutin, regardless of its outsole color. A hearing date has been set for January 24 for each side’s lawyers to duke it out in court.
