Not to mention that Boulud even anticipated when noise levels would be loud because of live music and offered to get the Pildes out of their place: “I am planning a party on behalf of Oprah Winfrey at Daniel on the evening of the 28th of December. We are going to have live music and I would not want you to be disturbed. Ms. Winfrey has asked me to extend an invitation for you to spend the night at the Peninsula Hotel including any spa services if you wish ” By the end of her ruling, Justice Carol Robinson Edmead is dismissive toward both the matter and the plaintiffs: “One occasion on New Year’s Eve does not a continuing, recurring nuisance make.” Party on, Justice Edmead!
