How Accurate Is Calorie Information?

Calorie posting seemed like a great idea to the Bloomberg administration, but the information could be totally wrong. Online magazine Gotham Gazette notes that, in some cases, independent testing shows that dishes have twice as many calories as are posted! In other cases, calorie counts may be off just because of the way a cook lays on the bacon. Since there is no degree of precision required by the New York law, restaurants can give any old number with no worries of a city testing program to check it out. But customers who think they are getting fraudulently fattened won't complain to the Health Department; they'll sue the restaurants, which is one reason the industry fought the law in the beginning. The moral is, as ever, don't believe everything you read.

Do Fast-food Chains Fear a Ban?

After months of appeals, delays, and squawks, the city's fast-food restaurants are, for the most part, complying with calorie-posting laws. According to the AP, city inspectors have issued only nine citations since enforcement began, on July 19. So was calorie posting not such a big deal, or is the industry dancing now because it fears the looming threat of a fast-food moratorium? Not that they're the only ones who find all this McLegislation troubling: Slate's William Saletan wrote a forceful and well-reasoned argument against the moratorium yesterday, calling it "food apartheid" and racist: "Telling certain kinds of restaurants that they can't serve certain kinds of people is just plain wrong, even when you think it's for their own good."

Fast food has taken a beating from city health authorities in recent years but always gets off the canvas. Now there are rumblings that some lawmakers in New York want to ban it entirely! Yes, it's true: City Councilman Eric Gioia of Queens wants to follow the lead of fast-food puritans in L.A. and impose a one-year ban on new fast-food restaurants, reports the Sun. "People are literally being poisoned by their diets — L.A.'s idea deserves serious consideration as we look for holistic solutions to a serious problem. A moratorium may help stem the problem," Gioia told the paper. Another councilman, James Oddo of Staten Island, likes the idea too. "I drive around my district and I see people engaging in incredibly unhealthy lifestyles that I know I pay for, to some degree," Mr. Oddo told the Sun. "If there's a way to make them have a healthier lifestyle so I don't pay for it, I would be open to it." The New York Restaurant Association is not so hot on the idea, and neither are we. Much as we long for a technocratic nanny state to come and take away our will, it can't be at the expense of BK Quad Stackers.

Bloomberg’s Last Meal; Starbucks Sandwiches Reprieved

• Mayor Michael Bloomberg channeled Elvis when describing what he would eat if he had one last breakfast: “Wonder Bread toasted, with Skippy Super Chunky melted on it, slices of overripe banana, and fresh, crisp bacon.” [NYP]

• With the salmonella-tomatoes fiasco not yet a memory, supermarkets around the country are pulling half a million pounds of beef from their shelves due to potential E. coli contamination that has already caused 40 illnesses. [NYT]

Calorie Laws Already Flouted by 75 Percent of Chain Restaurants

As expected, the great majority of the city's restaurant chains, having been assured by the city that no fines will be levied until July 18, has continued not to post any calorie info, the Post reports. “We see this as an educational period. We are not issuing fines, we are trying to help the owners of the establishments understand the new rule," Health Department deputy commissioner Jessica Leighton tells the Post. Talk about laying down the law! Leighton estimates that only about a quarter of the city’s 2,000 chain eateries are actually bothering to comply, so it might be a hard wake-up when the city is forced to show the chains who’s boss. If indeed the city really is boss.

McDonald's CEO Lashes Out at Calorie Posting

You probably didn't expect Jim Skinner, the CEO of McDonald's, to have anything good to say about the city's new calorie-posting laws, but we were surprised to see the Mayor of McDonaldland openly fulminating to the Chicago Tribune yesterday. Calling the regulations “redundant and flawed,” the burger titan claimed that McDonald's has been offering calorie information for decades. The burden of the new posting rules has been laid on McDonald's by "professional naysayers" and "CAVE people — Citizens Against Virtually Everything," complained Skinner. Judging by the online comments, Chicagoans are with him all the way: Though a few stood up for the regulations (“It would be great to know the nutritional 'value" of what I'm eating. The menu is the BEST place for this information!!!!!”), just as many or more are sympathetic to McDonald's plight (“Isn't everybody just sick to death of these know-it-alls who are just the loudest, pushiest, most demanding bunch of jerks”). Skinner even gets some love: “I used to caddie for CEO Skinner years ago at a country club in St. Charles before he was CEO. Hilarious and generous guy. He'd take down a pack of heaters during the round. He'd drink the McD's coffee. Keep up the good work, Jimmy boy!” Maybe Chicago is just in a libertarian mood after throwing off its foie gras ban.

Calorie-Posting Stay Denied by Court

The New York Restaurant Association has lost its latest skirmish with the city about calorie posting, but the city, in a pandering show of goodwill, won't fine any restaurant until July 18. Per the city's press release:

“In a quick resolution of this issue this afternoon (Tuesday, April 29, 2008), Judges Chester Straub, Rosemary Pooler and Sonia Sotomayor of the Second Circuit Court of Appeals have just ruled against the New York State Restaurant Association's "motion for a stay" of the New York City calorie posting rule (Health Code 81.50). This means that the regulation becomes effective subject to the court's consideration of the larger appeal. (So the regulation would be in effect while the larger appeal is being considered. The Health Department will NOT impose any fines until after midnight on Friday, July 18th. This date is pushed up from an earlier June 6th date to give restaurants additional time to comply.)

The NYRA will continue to appeal, of course, but so far its record in court is not promising.

A recent appeal has kept everyone wondering: What will happen when the law requiring New York's chain restaurants to post calorie counts on their menus finally takes effect? Will tumbleweeds roll through Starbucks as coffee drinkers realize just how fattening that Frappuccino is? Calorie information is already available online for most chains. According to a rep, since IHOP started posting calorie counts almost two months ago, “guest reaction has been almost nonexistent.”

The New Yorkers we surveyed at Chipotle and Starbucks in Union Square yesterday didn't seem too concerned. But after perusing some of the juicy morsels we’ve dug up, they might just consider the Baconator a “healthy” option.

Calorie Postings Delayed Yet Again!

When, oh, when, will New York at last get the calorie postings we so obviously desire?
The New York Restaurant Association has somehow managed to get a ruling delaying enforcement of the law pending (another) appeal. How long is this supposed to go on for? We have been looking forward to seeing the Quad Stacker unmasked and enjoying the suicidal thrill of ordering one, even with its horrors plain to see. Meanwhile, the NYRA seems to have more appeals in them than Mumia Abu-Jamal. Just give in already! We’ll still eat your hideous foods.

The Calorie-Disbelief Bandwagon Rolling Already

As predicted here yesterday, the media is already enjoying watching customers at chain restaurants recoil in horror at seeing just how fattening their favorite foods are. The Times gets in on the action today, going to Starbucks and trolling for responses exactly like this one: “I’m surprised, especially about the Iced Lemon Loaf,” [a customer] said, referring to something that looked like a slice of lemon pound cake with frosting. “It’s 500 calories. That’s like a Big Mac. It’s like a meal.” Actually, she's right — a Big Mac is 540 calories. But who's counting?

Food Blogs Already Having Sport With Calorie Listings

Expect a lot of shock-and-awe tactics on the part of the city’s food-writing corps, as calorie info begins to go up in chain restaurants around town. First on the beat is the Voice’s new blogger, Sarah DiGregorio, who stops in at T.G.I. Friday's to find that the ribs there are a horrific 1,900 calories. From there it’s on to Starbucks, where the blended-cream green tea has 650. The other chains DiGregorio stopped by still hadn’t gotten with the program: The Sbarro and McDonald’s locations she visited “hadn’t even heard of the law,” the Olive Garden presumably has its hands full dissuading waitresses from getting naked for Playboy, and as for Bubba Gump, a manager claimed that everybody is “very excited about it.” Something tells us that this excitement isn’t misplaced. There’s a lot of comedy coming our way.

City Retains Right to Call You Fat

New Yorkers are one step closer to knowing how disgusting they are since a federal judge approved the city's efforts to mandate calorie counts on menus, according to the AP. The New York State Restaurant Association had appealed the law, claiming it violated First Amendment laws by forcing restaurants to be mouthpieces for the city's health-propaganda machine. The restaurants will appeal again, so you can still suspend disbelief at lunchtime.

Fast-food Menus Need Calorie Info by Monday, City Says

Chain restaurants have until Monday to start posting calorie information, but don't expect to see all the signs go up at once. AM New York reports that the New York Restaurant Association has appealed the law and that the city won’t fine offenders until June, though it will issue citations. Even the first signs to go up have elicited a predictable response: “Wait, the chips and guacamole are 710 calories?" the paper quotes one Chipotle customer asking rhetorically. Wait till she sees what a Quad Stacker will run her!

Calorie Law Put on Hold; ‘Top Chef’ Spike to Open Burger Joint

• A judge is barring the Health Department from enforcing the law requiring chain restaurants to display calorie info on menus, until April 14, by which time he’ll have decided what to about the New York State Restaurant Association’s lawsuit against the city. [NYP]

Calories to Show Up on Menus Starting March 31; Mercury Levels Horrifically High in Tuna Sushi

The Board of Health decided yesterday in a unanimous vote to make all chain restaurants with fifteen or more outlets – approximately 10 percent of the city’s restaurants – post calorie info on their menus starting March 31. RIP, 1,230-calorie triple Whopper with cheese. [CNN]

Laboratory tests run on sushi samples from twenty Manhattan stores and restaurants revealed shockingly high levels of mercury in bluefin tuna, so high that the FDA could technically take the fish off the market. And if you’ve got to have your tuna sushi, you’d best head to Fairway and avoid Blue Ribbon Sushi at all costs. [NYT]

Gluttons in denial about their diet will be overjoyed to hear that a federal judge has ruled against Mayor Bloomberg’s plan to make fast-food restaurants post calorie information. (Naturally, the New York State Restaurant Association, a lobby group representing the fast-food interests, isn’t too sad about it either. ) But the reasons for the decision seem surprisingly weak.
