The Hampton Bays Diner is suing the town of Southampton, its police department, and the SLA, based on allegations that, per court papers that Cityfile has obtained, cops “launched a series of attacks upon the plaintiffs, with the intent to prevent the plaintiffs from continuing to draw Hispanics into their restaurant, and to prevent them from doing so in the first place.” According to papers, the Diner, after it started a Hispanic Night, was raided more than once in order to drum up “trumped-up charges” that were then dismissed in court. However, it didn’t end there.
• Another day, another lawsuit. Staffers at Jay-Z’s 40/40 are lobbing a class-action suit at the club, but general manager Desiree Gonzalez allegedly told one employee she would “[bleep] up his tax life” and told another she would “lock him up” if they joined the suit. [NYP]
• Nello Balan wasn’t too happy yesterday when a fog machine set off the fire alarm at his Nello Summertimes in Southampton. Fire officials responding to the alarm evacuated the restaurant, which cost Balan about $10,000 in business. [NYP]
• John Krasinki of The Office guested as a bartender at the Spotted Pig on a recent Monday night. [Mouthing Off/Food & Wine]
• Government officials investigating the salmonella outbreak are now eying three kinds of hot peppers, including jalapeños, as the leading suspect for spreading the bacteria. [WSJ]
• With several restaurants out of business and others for sale, even dining destinations in the chichi Hamptons are suffering from the current economic downturn. [Real Deal]
• Three waiters at the Old Homestead Steakhouse say that ever since they sued the restaurant and won the case, they’ve been given the most undesirable tables in the house. Naturally, they’re filing another lawsuit. [NYP]
• Grayz will be closing on August 10 and reopening as a full-fledged restaurant. [NYS]
• Andrew Carmellini is officially out at A Voce, and Fran Derby, formerly of Tailor, is cooking at Solex. [NYT]

Every summer, the big names in bottle service play a game of musical chairs, scrambling to put their stamp on the few available club and restaurant spaces in the Hamptons. This year, there were rumors that Pink Elephant would lose its lease (or at least its outdoor patio) at the Capri Hotel; the future of the Star Room was uncertain; and one of Southampton’s bump-and-grind destinations, Stereo, closed their Manhattan location. But breathe easy! Our research indicates that everything turned out mostly fine. Here’s where to pop some very overpriced bubbly by way of celebration.
Hamptons: Sounds like the poor state of the economy is weeding out this year's batch of beachgoers. [Down by the Hipster]
Park Slope: Lookout Hill Smokehouse needs to work on its pulled pork, but its beer and bourbon selection is legit. [Mouthing Off/Food & Wine]
Soho: Tailor launches its late-night menu tonight, which runs from 11 p.m. to 2 a.m. and includes plated dishes like grilled asparagus with poached-and-fried quail eggs and chorizo hollandaise, skate frites with purple potato tots, and the always-popular Tailor wings. [Grub Street]
A scathing crowd assessment at SubMercer: "The crowd itself isn't always up to par; you may find yourself mingling with the white v-neck-wearing Jersey set." Ouch. [Bottomless Dish/Citysearch]

Meatpacking District: The closing of Florent's has touched even the coldest of hearts: "You know things are getting bad...when the cynical young keyboard-tappers at Gawker think the City is changing too fast and losing too many of its great places." [Lost City]
Soho: Adam Kuban verifies that even though Kenn's Broome Street Bar burger is on a pita, flouting the most basic of hamburger rules, it can be dubbed a burger, and the version with bacon is a pretty good option in the hood. [Hamburger Today]
Times Square: The rechristened China Club, Eden, opens tonight. [Bottomless Dish/Citysearch]
West Village: Interns (probably) weren't paid to put the "Britney Spears" stickers on the windows of the Life Thyme natural market (and all over the rest of the city) to promote a book that isn't about Britney. [Gothamist]
Astoria: Pinocchio's will reopen Sunday after its monthlong renovation. [Joey in Astoria]
Dumbo: Jay Street gets a liquor store. [Dumbo NYC]
East Harlem: All attempts to revive the market known as La Marqueta have failed, but that doesn't stop proponents from trying. [NYT via Uptown Flavor]
East Village: A kati-roll spot has opened on Second Avenue, between 11th and 12th. It's called Frankie's, even though the nabe already has Frankies, Lil' Frankies, and Frank, because, according to the owner, "in Bombay, Frankie's are wraps that you buy on street corners." [Eater]

Thought being near the ferry was crucial to a Hamptons club’s survival? Hamptons.com reveals that Unik Ernest, of shuttered PM (and Merkato 55), is teaming up with Mike Satsky, of shuttered Stereo, to open a club, Lily Pond, that will be just a mile away from a helicopter pad. Which means that Escalades are no longer the most impressive thing you can pull up to a club in.

The American Medical Association gets behind the city’s requirement that fast-food chains post calorie and other nutritional information on their menus. Not that the chains have any intention of complying. [Nation's Restaurant News]
Ratatouille is being hailed as an instant classic, especially for foodies: “The food is drawn and imagined so beautifully (with the help of French Laundry chef Thomas Keller, who consulted on the movie) that you walk out wishing you'd made reservations at Per Se.” [Slate]
