Judge Orders Guantánamo Detainee Freed, Citing Obama’s New Policies

Mohammed Jawad, a Guantánamo detainee who is accused of throwing a grenade into an armored car carrying two U.S. troops in Afghanistan, was issued a writ of habeas corpus by a judge this morning. District Court Judge Ellen Segal Huvelle gave 22 days for the Justice Department to figure out whether they will continue to try to prosecute Jawad in a U.S. criminal court. At the time of his arrest in 2002, Jawad confessed to the crime under interrogation. Later, he claimed he was tortured into a false confession; under Obama's new rules for detainees, this evidence is unusable. It's unclear what the Justice Department's plans are. According to ABC News, they have "new evidence" and are investigating whether they can make a criminal case.
