As we approach the Senate confirmation hearing of Elena Kagan, it seems clear that Republicans have yet to figure out an effective line of attack against her. “In Supreme Court confirmation proceedings, it is usually up to opponents to show that a nominee should not be confirmed because of a lack of qualifications, judgment or character,” NPR reports. “But [Republican senator Jon] Kyl said it is Kagan who bears ‘the burden of proof’ because she lacks a track record as a judge that can be examined.” So get ready to “prove” that you should be on the Supreme Court, Elena Kagan, whatever that means.
