Even Federal-Appeals Courts Are Over the Winklevii’s Facebook Suit

A federal-appeals court declined to review a challenge from Cameron and Tyler Winklevoss over their $65 million settlement with Facebook. Without comment today, the Ninth Circuit Court of Appeals, which already ruled last month that the Winklevii can’t undo the settlement, refused to have an 11-judge panel review the case (again). Don’t breathe easy just yet, Mark Zuckerberg. The litigious Ken dolls still have two cards up their well-tailored sleeves: plans for a legal challenge in Boston over whether Facebook and its lawyers concealed instant messages during the trial and — if that doesn’t work out — there’s always the Supreme Court.
