The Case: In November 2003, Jennifer Luna’s primary care doctor detected a lump in her thyroid, and a sonogram revealed five solid nodules, without lymph node involvement. He sent her to an endocrinologist, but neither physician ordered a fine needle aspiration biopsy, the only definitive diagnostic tool. One year later, Ms. Luna was diagnosed with Stage IV metastatic medullary thyroid cancer.

The Verdict: After a five week trial in Suffolk County Supreme Court, Diane Paolicelli and Daniel Woodard achieved a verdict of over $7 million in favor of Ms. Luna.


The Case: In August 2006, Dulce Ulloa detected a lump in her left breast. A mammogram and sonogram were misinterpreted as “normal” and her primary care doctor did not refer her for a biopsy. In November 2007, Ms. Ulloa was diagnosed with Stage IV breast cancer with metastasis to her lungs. She filed suit against the hospital and radiologist for negligently interpreting the mammogram and sonogram, and against her primary care doctor for not referring her for a biopsy.

The Settlement: Danielle George secured a $3 million settlement for Ms. Ulloa.
