The Case: In November 2003, Jennifer Luna’s primary care doctor detected a lump in her thyroid, and a sonogram revealed five solid nodules, without lymph node involvement. He sent her to an endocrinologist, but neither physician ordered a fine needle aspiration biopsy, the only definitive diagnostic tool. One year later, Ms. Luna was diagnosed with Stage IV metastatic medullary thyroid cancer.
The Verdict: After a five week trial in Suffolk County Supreme Court, Diane Paolicelli and Daniel Woodard achieved a verdict of over $7 million in favor of Ms. Luna.
The Case: In August 2006, Dulce Ulloa detected a lump in her left breast. A mammogram and sonogram were misinterpreted as “normal” and her primary care doctor did not refer her for a biopsy. In November 2007, Ms. Ulloa was diagnosed with Stage IV breast cancer with metastasis to her lungs. She filed suit against the hospital and radiologist for negligently interpreting the mammogram and sonogram, and against her primary care doctor for not referring her for a biopsy.
The Settlement: Danielle George secured a $3 million settlement for Ms. Ulloa.
For over 25 years, Levy Phillips & Konigsberg has been a national leader in complex personal injury litigation, consistently obtaining multi-million dollar results for catastrophically injured victims of occupational and environmental torts, drug and product liability, construction accidents and medical malpractice.
The Medical Malpractice Team, led by partner Diane Paolicelli, along with attorneys Danielle George and Daniel Woodard, approaches each case with one goal in mind: to obtain justice in the form of top compensation, so the client and family can live out their lives with dignity and comfort, even in the face of tragic illness.
The members of the Medical Malpractice Team are each accomplished trial lawyers, who know that the way to maximize recovery is to work up each case as if it were going to trial. Their caseload is selective, so that they can devote the necessary resources and energy to securing outstanding results for the most grievously injured. They have obtained life-changing results for stroke survivors, quadriplegics, brain damaged children, and cancer victims, such as the two featured here in New York’s top verdicts and settlements for 2012. No case is too challenging or complex. The firm’s lawyers routinely take on cutting-edge litigation - cases that other lawyers turn away. A special emphasis in recent years has been the protection of children born with debilitating birth defects due to in utero exposure to pesticides, chemicals, and heavy metals. Says Ms. Paolicelli, “If we hit institutional defendants where it hurts – in their pocketbooks – perhaps we can persuade them to act responsibly, and make this world a safer place for all our children.”
