A longstanding New York City legal institution in negligence law, with roots dating back to the 1920s, The Jacob D. Fuchsberg Law Firm has devoted its entire existence to representing the rights of plaintiffs who have found themselves a victim of serious wrongdoing or neglect, no matter the cause or arena. The boutique firm takes on legal cases covering the expanses of personal injury and individual rights, including traumatic birth injuries such as cerebral palsy caused by medical malpractice, lead paint child poisoning, motor vehicle accidents with devastating consequences, labor/workplace injuries caused by unsafe conditions, and drug reaction and pharmaceutical device liability claims, as well as employment discrimination and civil rights abuses.

In the past several years, the firm has obtained outstanding results for injured or victimized individuals and their families, providing them a full and just award to fairly compensate them for their loss or occurrence. Recently, the firm garnered a jury award of more than $19 million for a widow on behalf of her 68-year-old, postal-worker husband, whose improper care during cardiac surgery resulted in his untimely death, and a $13 million verdict on behalf of a woman who had a portion of her leg amputated as a result of medical mismanagement. Also, following a trial, the firm obtained a record breaking settlement for members of a Brooklyn family diagnosed with lead poisoning, and a multimillion dollar settlement for a man who suffered a stroke following an ER misdiagnosis and as a result entered a locked-in state for several years until the time of his death.

In addition, the firm has obtained many strong settlements by following their ethos of thoroughly developing a case for trial. For example, a thirteen year old boy paralyzed by delay in diagnosis of a spinal tumor received a $7.5 million settlement; a case of a woman who became permanently comatose as a result of poor anesthesia monitoring during a surgical procedure was settled for $8 million; a settlement was reached for $7 million shortly before the trial of a product liability case against an automobile manufacturer; several significant mass tort litigation settlements were obtained for drug and pharmaceutical product liability cases; and finally, there have been numerous precedent-setting class action settlements in employment law. The firm’s experienced medical malpractice department has addressed every imaginable injury as a result of mishandled medical care, including delay in diagnosis of breast and other cancers, surgical errors, untreated infections, blood transfusion or hospital born infections, and prenatal, labor, and delivery issues. Though each of the firm’s attorneys knows that no amount of money can ever replace that which has been lost by the victim, they strive to gain a modicum of justice for those who have been injured due to the fault of others.

Senior Trial Partner Leslie Debra Kelmachter describes the accomplishments of the female attorneys with the firm: Carrying n a long legal tradition, the firm is equally balanced between women and men, and benefits from the guidance of legendary Senior Counsel Rosalind Fuchsberg Kaufman, the practice’s first female partner. Partner Leslie Lewis calls upon her background in nursing as well as her trial experience in her work as a medical malpractice and personal injury litigator; associate Karen Padreza also relies on a nursing background, as well as eleven years spent on the defense side of medical malpractice litigation; Elena Carter focuses on medical malpractice, nursing home abuse; and Counsel to the firm, Jill L. Brooks, specializes in employment discrimination and employment law.
