Employees of Delta Air Lines and Primedia Inc.NEW YORK Magazine, their respective parents, subsidiaries, affiliates, advertising and promotion agencies and their family/household members are not eligible to enter.

5. The prize-winner will be selected by random drawing from all entries on or about Tuesday, December 3, 2002. The drawing will take place under the supervision of NEW YORK Magazine and Delta Air Lines. Participants agree to be bound by these rules and the decision of the judges, whose decisions are final. The total number of entries received will determine odds of winning. The winners will be notified by telephone or e-mail by Tuesday, December 3, 2002. 6. There is one grand prize. The grand prize-winner receives two Delta nonstop round-trip BusinessElite® U.S. tickets between New York City and Los Angeles or San Francisco. Winner must claim and use tickets before December 31, 2003. The estimated retail value of the prize is valued at $2,600. All other expenses of travel are the responsibility of the winner. Delta Air Lines and NEW YORK Magazine make no warranties with regard to the prizes. Prize is nontransferable. No substitutions of prize allowed by winner, but Delta Air Lines reserves the right to substitute a prize of equal or greater value. Prizes is are not redeemable by winner for cash value.
7. All entries and requests become the property of NEW YORK Magazine and Delta Air Lines and will not be acknowledged or returned. NEW YORK Magazine and Delta Air Lines will have the right to photograph the winner. Entry constitutes permission to use the winner's name, picture, likeness and city and state or residence for purposes of trade, publicity or promotion for no additional compensation except where prohibited by law.
8. The winner and traveling companion will be required to execute an affidavit ofr eligibility, compliance with sweepstakes rules and release of liability prior to ticketing. All taxes on prizes are solely the responsibility of the winners.

All entrants release NEW YORK Magazine and Delta Air Lines, their affiliates, parents, subsidiaries, directors, officers, employees, and agents, and all others associated with the development and execution of this sweepstakes from any and all liability from injury, loss or damage of any kind resulting from participation in this promotion or acceptance or use of any prize.
10. Failure to execute and return any requested document within fourteen (14) days of postmark, or return of notification or prize as undeliverable may result in forfeiture of prize. An alternate winner will be selected. All reasonable effort will be made to contact the winner.
