Marc Jacobs Sues Christian Audigier

Marc Jacobs is suing Christian Audigier for trade-dress and trademark infringement over a handbag that's suspiciously similar to one he designed. Jacobs's trademark of the scrambled Marc Jacobs logo is pending, but the label says the bag's "size, shape, color or color combinations, product design, texture, and selection and arrangement of materials and accessories" make up its trade dress, or identify the bag to consumers as a Marc Jacobs item. Audigier's bag is "confusingly similar" to Jacobs's, according to the suit. This is quite something — a lawsuit to prevent consumers from confusing Christian Audigier with Marc Jacobs. Even if they lose, we're pretty sure consumers will be able to keep the two straight, but when someone seemingly takes your design and puts a tattoo-print fish on it, the offense is that much worse.
