Students convicted of sexual assault in New York might carry the offense with them permanently. Part of Governor Cuomo’s proposed legislation to combat campus sexual assault requires colleges to mark the transcript of any student convicted of a “crime of violence.” The exact wording is: “suspended/expelled after a finding of responsibility for a code of conduct violation.”
If a student withdraws pending charges, their transcript will note that, too — the goal is to keep students from transferring to avoid charges, which is a popular tactic. A student could appeal to have their transcript cleared after a one-year suspension.
The bill passed in both the New York Senate and the State Assembly on Wednesday, but it has yet to be signed into law. Virginia is the only other state with a similar law in place.
