H&M to Forever 21: “Beach Please.” The Fashion Law reports that the Swedish fast-fashion brand is suing the American fast-fashion brand for “copyright infringement, trade dress infringement, false designation of origin and unfair competition” — all because of a palm-print tote bag bearing that less-than-uproarious slogan.
According to the court filing obtained by the site, H&M began offering its design in April 2014, and the similar-looking Forever 21 bag followed suit. The lawsuit also notes that Forever 21 “has also been accused of copyright violations in the past.” That said, so has H&M — for example, Converse recently sued the company for manufacturing shoes it deemed too similar to the sneaker company’s Chuck Taylor style, a conflict the two eventually settled. Via a rep, H&M had no comment on the matter; Forever 21 told us, “As company policy, we are unable to comment on pending litigation.”
